Welcome to Can You Dig It. These Terms and Conditions govern your use of our services, including but not limited to demolition, dirt work, gravel driveway installation, brush hogging, and forestry work (collectively, the "Services"). By engaging with our Services, you agree to these Terms.
1. Scope of Services
1.1. Service Agreement: Services provided by Can You Dig It will be outlined in a written agreement or estimate ("Service Agreement") detailing the scope, timeline, and cost. 1.2. Changes to Scope: Any changes to the agreed scope of work must be documented in writing and may be subject to additional charges.
2. Estimates and Payment
2.1. Estimates: All estimates provided are based on the information available at the time. Variations in the worksite conditions may result in additional charges. 2.2. Deposit: A deposit may be required to secure your project on our schedule. 2.3. Payment Terms: Full payment is due upon completion of the Services unless otherwise specified in the Service Agreement. Accepted payment methods include checks, cash, and credit cards. 2.4. Late Payments: Unpaid balances are subject to a late fee of $99.00 per month.
3. Customer Responsibilities
3.1. Access to Worksite: The customer is responsible for providing safe and unrestricted access to the worksite. Delays caused by restricted access may result in additional charges. 3.2. Permits and Approvals: Unless otherwise agreed, the customer is responsible for obtaining any necessary permits or approvals before work begins. 3.3. Utilities: The customer must identify and mark all underground utilities or structures on the property. We are not responsible for damages to unmarked utilities.
4. Warranties and Disclaimers
4.1. Workmanship: We warrant that our Services will be performed in a professional and workmanlike manner. 4.2. Materials: Materials supplied by the Company are warranted as per the manufacturer’s warranty, if applicable. 4.3. Exclusions: We do not guarantee against natural forces, future erosion, or conditions outside of our control that may affect the worksite post-completion. 4.4. Liability Limitation: Our liability is limited to the cost of the Services provided. We are not liable for indirect, incidental, or consequential damages.
5. Health and Safety
5.1. Safety Measures: Can You Dig It adheres to all applicable safety regulations during the performance of Services. 5.2. Hazardous Conditions: If hazardous conditions are identified, work will cease until the hazard is remedied at the customer’s expense.
6. Cancellations and Refunds
6.1. Cancellation by Customer: If the customer cancels the Service Agreement, any deposits paid may be forfeited, and additional charges may apply based on work completed. 6.2. Cancellation by Company: We reserve the right to cancel the Service Agreement for reasons including, but not limited to, unsafe conditions, failure to provide access, or non-payment.
7. Dispute Resolution
7.1. Good Faith Negotiation: Both parties agree to negotiate in good faith to resolve any disputes. 7.2. Mediation/Arbitration: If negotiations fail, disputes will be resolved through [mediation/arbitration] in [location].
8. Governing Law
8.1 These Terms are governed by the laws of the state of Texas, without regard to its conflict of law principles.
9. Force Majeure
9.1 We are not liable for delays or failure to perform due to circumstances beyond our control, including but not limited to acts of God, weather, or governmental actions.
